Terms of Service

1. About Quietly Hosted

Quietly Hosted is a UK-based hosting, domain, and email service operated by Colin Thurston as a sole trader (“Quietly Hosted”, “we”, “us”).

Business correspondence (only where email is not possible) may be directed to: Office 7, Chard Enterprise Centre, Somerset, TA20 1BB, United Kingdom.

These Terms govern your use of Quietly Hosted’s website hosting, domain registration, email hosting, and related support services (“Services”). By using the Services, you agree to these Terms.

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Business use only

Quietly Hosted’s Services are provided for business use only.

By entering into an agreement for Services, you confirm that you are acting in the course of a trade, business, craft, or profession, and not as a consumer.


3. Services

Quietly Hosted provides:

  • Managed website hosting
  • Domain registration and management
  • Email hosting
  • Support related to the above

Infrastructure is provided using reputable UK-based providers (including Krystal and Cloudflare where appropriate). Services are provided on a best effort basis. Unless expressly stated, no formal service level agreement applies.

4. Service scope and limitations

Hosting infrastructure is managed by Quietly Hosted. Direct access to server level control panels (such as cPanel) is not provided by default but may be made available upon request where appropriate.

Where client access is granted, clients are responsible for changes made within their accounts. If remedial work is required following client initiated changes, this may be covered under an applicable Care or Managed plan, or may be chargeable where outside plan scope.

While we aim for reliable, continuous service, uninterrupted uptime cannot be guaranteed.

We are not responsible for service interruptions caused by factors beyond our reasonable control, including third party outages, network failures, upstream provider issues, or force majeure events.

Daily backups may be taken where included in your plan. However, you remain responsible for retaining copies of critical business data and ensuring content accuracy.

Hosting plans are intended for standard business websites. Use of server space for file storage, archiving, or high resource activity outside normal website operation is not permitted.

We reserve the right to request usage reductions, apply reasonable limits, or suspend services if usage materially exceeds normal levels or impacts platform stability.

You are responsible for maintaining the security of your passwords and account access.

Quietly Hosted is not responsible for incompatibilities, performance issues, or service disruption arising from third party software, plugins, themes, integrations, or external services not directly controlled by us.

If we reasonably believe a website, email account, or service is compromised (for example, sending spam or hosting malware), we may take proportionate steps to protect the platform and other customers, which may include temporarily disabling access or isolating the affected service. We will make reasonable efforts to contact you and explain what happened.

5. Work outside plan scope

Each plan includes the services described on the relevant plan page. Work outside that scope may be declined or may be offered at an agreed additional charge.

Where additional work is required urgently, involves third party issues, or arises from client initiated changes, we will explain the options clearly before proceeding.


6. Support

Support is provided via email.

Response times depend on your plan. Unless your plan states otherwise, we aim to respond within 2 business days.

Support outside email (including phone or live chat) is not included unless separately agreed in writing.


7. Acceptable use

You must comply with all applicable UK laws and the hosting platform’s acceptable use policy.

Reselling services, hosting illegal content, or operating high traffic applications beyond plan scope is not permitted.

You are responsible for the content you host and any activity carried out using your services. This includes ensuring you have the rights to publish content and that your site and email usage does not infringe third party rights.

If we believe your use of the Services breaches acceptable use rules, creates a security risk, or may harm service reputation (for example, spam or malware), we may suspend or restrict the Services while the issue is investigated.

8. Payments and minimum term

Services are billed monthly, in advance, unless otherwise agreed.

A minimum term of 3 months applies to new services. After the minimum term, Services continue on a rolling monthly basis until cancelled.

Payments are collected via Direct Debit (GoCardless) or another agreed method.

If payment fails, we will contact you to resolve the issue. If payment remains unpaid after reasonable notice, Services may be suspended until payment is received.

We may change pricing from time to time. Where pricing changes apply to your Services, we will give reasonable notice by email. If you do not wish to continue at the new price, you may cancel before the change takes effect.

9. Cancellation and offboarding

You may cancel your Services at any time by providing written notice.

Cancellations take effect at the end of the current paid billing period unless otherwise agreed. The Services will remain active until that time.

If you cancel during the 3 month minimum term, you remain liable for fees due for the remainder of that minimum term.

Domain registrations are non refundable once processed. Domain renewal fees, where applicable, remain payable if a renewal has already been actioned on your behalf.

Upon termination, we can provide a full cPanel backup on request. Backups are retained for 28 days following termination.

10. Domains and data

You retain ownership of your website content and data.

Domains are registered on your behalf and may be transferred to you at any time upon request.

You are responsible for compliance with data protection laws in relation to content and personal data collected through your websites and email accounts. Quietly Hosted acts as a hosting provider and does not determine the purposes or means of processing client data.

11. Changes to services or terms

We may update these Terms from time to time.

Material changes will be communicated via the email address on file.


12. Liability

Nothing in these Terms excludes liability which cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to the above, Quietly Hosted’s total aggregate liability arising out of or in connection with the Services shall not exceed the total amount paid by you in the preceding 12 months.

Quietly Hosted is not liable for indirect or consequential loss, including loss of business, revenue, profits, goodwill, or data.
